Title 42 › CHAPTER 84 — DEPARTMENT OF ENERGY › SUBCHAPTER VI — ADMINISTRATIVE PROVISIONS › Part C — General Administrative Provisions › § 7261a
When a contractor invents something while working on certain Department of Energy defense contracts and asks to get the government's ownership, the Secretary of Energy can give the government’s rights to the contractor. The Secretary must decide within 150 days after getting a complete request. A complete request must include the information the Secretary’s rules say is needed. If the Secretary misses the 150‑day deadline, they must tell the House and Senate Armed Services Committees why within 10 days after the deadline. If a decision is still not made, the Secretary must send another report every 30 days until the decision is finished. In deciding, the Secretary must also think about national security, whether sensitive technical information would be released, possible conflicts of interest, and whether not claiming rights would hurt the Navy propulsion, weapons, or other atomic energy defense programs, along with any other applicable policies.
