Title 42 › CHAPTER 84 — DEPARTMENT OF ENERGY › SUBCHAPTER XVI — ENERGY EMPLOYEES OCCUPATIONAL ILLNESS COMPENSATION PROGRAM › Part B — Program Administration › § 7384s
Covered employees, or their survivors if the worker died, must get $150,000 for disability or death caused by a work-related illness. If the illness is confirmed as beryllium sensitivity, the worker gets beryllium sensitivity monitoring instead of the $150,000. That monitoring includes a full initial medical exam to confirm the sensitivity and regular follow-up exams to watch for chronic beryllium disease. Workers also receive medical benefits under section 7384t. Payments approved by the President are paid from the compensation fund created under section 7384e. If the worker is dead when payment is made, the money goes in this order: spouse; if no spouse, living children split it; if no children, living parents; if no parents, living grandchildren; if none of those, living grandparents. If there is a surviving spouse and at least one living minor child of the worker who is not the spouse’s natural or adopted child, half goes to the spouse and the other half is divided equally among those minor children. If the worker died before filing a claim, an eligible survivor may file. Definitions used here: spouse (married at least one year before death), child (natural child, stepchild who lived with the worker, or adopted child), parent (includes adoptive parents), grandchild (child of a child), grandparent (parent of a parent). The rule takes effect on July 31, 2001, unless Congress changes that date before then.
