Title 42 › CHAPTER 88 — URANIUM MILL TAILINGS RADIATION CONTROL › SUBCHAPTER I — REMEDIAL ACTION PROGRAM › § 7913
The Secretary can make agreements with a State to clean up each designated processing site in that State (except sites on Indian lands). The Secretary must start preparing those agreements soon after a site is designated and, as much as possible, follow the cleanup priorities the Secretary set. Each agreement will set rules the Secretary thinks are needed and will limit federal money to the costs directly needed to finish the chosen cleanup. Unless the State must buy the site under section 7914(a), the State must get written consent from anyone who holds a recorded interest in the site, using a form the Secretary sets. That consent must include a release and a promise to hold the United States harmless for claims related to the cleanup. Agreements must also let the Secretary, the Commission, the Administrator, and their representatives enter and inspect the site at any time; entry rights for the area in section 7911(6)(B) end when the Secretary says the cleanup is finished. An agreement only takes effect when the Commission agrees to its terms. The Secretary may reimburse a property owner of record for actual cleanup costs for the area in section 7911(6)(B) only if the work was finished before November 8, 1978, the owner files a claim within one year after the agreement is approved by the Secretary and the Commission, and the Secretary finds the work meets the goals of this chapter and the standards set by the Administrator under section 2022(a).
