Title 42 › CHAPTER 91 — NATIONAL ENERGY CONSERVATION POLICY › SUBCHAPTER III — FEDERAL ENERGY INITIATIVE › Part B — Federal Energy Management › § 8256
Agencies must set up programs that give workers and managers incentives when energy is saved through certain contracts. The Secretary must make rules for those incentives not later than 18 months after October 24, 1992, after talking with other officials. The Secretary must also create a Federal Energy Efficiency Fund to give grants that help agencies meet section 8253. By June 30, 1993, the Secretary must issue grant guidelines. Any agency can apply. Grants are awarded after a competitive review that looks at cost-effectiveness, expected energy and dollar savings for the Federal Government, how much the agency is contributing, whether non-Federal money is leveraged, and other factors that increase savings. Up to $10,000,000 is available for fiscal year 1994, $50,000,000 for fiscal year 1995, and such sums as may be necessary after that. Agencies may join utility programs for energy or water savings, accept utility incentives or goods, negotiate programs with utilities, and, if they meet the usual customer rules, cannot be denied rebates or other utility incentives. The Secretary must also set up a bonus program, with the Task Force, to reward outstanding Federal facility energy managers and Postal Service managers. Procedures and selection criteria must be issued by June 1, 1993; criteria include improving energy performance, using proven efficiency methods, training staff, raising employee awareness, winning utility incentives or shared-savings contracts, meeting energy reduction rules (including section 8253), and following section 8262e guidelines. Up to $250,000 is authorized for each of fiscal years 1993, 1994, and 1995. Agencies may keep money saved from lower energy, water, or wastewater costs at buildings covered by sections 8253(a) and (b), but must use those funds only for energy efficiency, water conservation, or unconventional and renewable energy projects. Those projects are subject to the requirements of section 3307 of title 40.
