Title 42 › CHAPTER 96 — BIOMASS ENERGY AND ALCOHOL FUELS › SUBCHAPTER I — GENERAL BIOMASS ENERGY DEVELOPMENT › § 8816
Under sections 8812 and 8817, the Secretary concerned may agree to buy some or all of the biomass energy a project produces if the Secretary finds the energy is the right type, amount, and quality for Federal agencies and the amount would not be more than agencies are likely to need. The Secretary must talk with the other Secretary before deciding on the amount. The sale price in the agreement normally cannot be higher than the estimated prevailing market price on the delivery date, as set by the Secretary of Energy, unless the Secretary concerned decides a higher price is needed to keep the project going. Before signing, the Secretary concerned must get promises that the fuel will meet use standards, be delivered on time, and include any other reasonable guarantees. The Secretary may arrange delivery to one or more Federal agencies, which will pay from their appropriations the market price for the product being replaced. Each contract must let the Secretary refuse delivery under specified terms and must state the United States’ maximum dollar liability. If needed to finish or continue a project essential to the program, the Secretary may renegotiate the sale price and the maximum liability. The Secretary must also consult with the Secretary of Defense and the Administrator of the General Services Administration when carrying this out.
