Title 42 › CHAPTER 99 — OCEAN THERMAL ENERGY CONVERSION › SUBCHAPTER I — REGULATION OF OCEAN THERMAL ENERGY CONVERSION FACILITIES AND PLANTSHIPS › § 9118
The Coast Guard’s department secretary must make and enforce rules, following international law, for any licensed ocean thermal energy conversion facility or plantship. The rules must cover things like how vessels move near the facility, how materials are transferred, where anchoring is allowed and how it is marked, upkeep and repairs, law enforcement, and required equipment and training. The rules must protect people and property at sea, prevent and clean up pollution, and reduce any harmful effects from building or running the facility. The secretary must also set rules about lights, warning devices, and safety gear. If a license holder does not mark a part as required, the Coast Guard will mark it and charge the license holder. After talking with Commerce, Interior, State, and Defense, the Coast Guard’s department secretary must set safety zones around any licensed facility (and may do so for plantships). The zones must list what activities are allowed and must be set no later than 30 days after publication of notice under section 9112(d). Safety zones can also apply during construction. Except in an unavoidable emergency, foreign-flag vessels may not use the facility unless the foreign government agrees to U.S. jurisdiction over the vessel and crew while inside the zone and the vessel owner names a U.S. agent for legal service. The secretary must also write and enforce rules about documentation, design, construction, inspection, certification, and crewing. Within 1 year after August 3, 1980, rules had to require that these facilities be documented, meet minimum design and construction standards, and be crewed by U.S. citizens or lawful permanent residents unless not enough qualified Americans are available or the President finds it against the national interest. Such facilities count as U.S. vessels for the Ship Mortgage Act of 1920. The Coast Guard must also make rules to protect navigation near vessels working on submarine electric cables and to govern their markings and signals.
