Title 42 › CHAPTER 99 — OCEAN THERMAL ENERGY CONVERSION › SUBCHAPTER I — REGULATION OF OCEAN THERMAL ENERGY CONVERSION FACILITIES AND PLANTSHIPS › § 9119
Require licenses to include conditions that protect navigation, fishing, energy production, scientific research, and other lawful uses of the high seas by U.S. citizens and by other nations. The Administrator must write rules that say when a facility’s thermal plume counts as harming another facility’s temperature gradient or harming another nation’s territorial sea or resource area as the United States recognizes. The rules must also let the Administrator help settle or decide disputes between licensees about plume effects. The Secretary in charge of the Coast Guard, after talking with the Administrator, must make and enforce rules about how plantships move. Those rules must keep a plantship’s plume from unreasonably harming another facility’s temperature gradient (except in cases of force majeure or with the other owner’s consent) and from harming another nation’s territorial sea or resource area unless the Secretary of State approves after consulting that nation.
