Title 42 › CHAPTER 99 — OCEAN THERMAL ENERGY CONVERSION › SUBCHAPTER III — ENFORCEMENT › § 9152
The Administrator can order people to comply and can force witnesses to testify, give documents, or be sworn for hearings. If the Administrator finds someone covered by the law is breaking a rule, they can order that person to fix the problem or ask the courts to act. Any order must say what the problem is and give a time to fix it, which cannot be more than 30 days. If asked, the Attorney General will sue to stop violations or to get other court relief. The Administrator can fine violators up to $25,000 for each violation, and each day a violation continues counts as a separate violation. People fined get a hearing and can appeal in federal court within 30 days. If a final penalty is not paid, the Attorney General will collect it. The Administrator can reduce or cancel penalties. Willful violations can also lead to criminal charges, with fines up to $75,000 per day, some offenses carrying up to 6 months in jail, and more serious acts (like using a weapon or harming or threatening a federal officer) carrying fines up to $100,000 or up to 10 years in prison. A ship or facility used in a violation can be held responsible if its owner or certain charterers knew about or agreed to the violation.
