Title 42 › CHAPTER 103 — COMPREHENSIVE ENVIRONMENTAL RESPONSE, COMPENSATION, AND LIABILITY › SUBCHAPTER I — HAZARDOUS SUBSTANCES RELEASES, LIABILITY, COMPENSATION › § 9608
Owners or operators of any vessel over 300 gross tons (except a nonself-propelled barge that does not carry hazardous cargo) must show they have money or insurance to cover pollution liability. They must have at least $300 per gross ton, or $5,000,000 if the vessel carries hazardous cargo, whichever is larger. Proof can be insurance, a guarantee, a surety bond from a company allowed to do business in the United States, a letter of credit, or qualifying as a self-insurer. If one company has several covered vessels, it only needs enough coverage for the largest vessel. The President must make rules for this. The Secretary of the Treasury can withhold a ship’s clearance if the President hasn’t certified compliance, and the Secretary of Transportation can deny entry or detain a ship that can’t show that certification. The President may also require extra coverage for incineration vessels. For certain production, storage, treatment, or disposal facilities, the President must create rules (starting not earlier than five years after December 11, 1980) and must name which facility classes to tackle first (not later than three years after December 11, 1980), giving priority to highest-risk classes. The money or coverage required will be set and adjusted based on experience and insurer data and must be phased in within 4 years of the rules. Multiple owners can provide combined coverage that shows each party’s share. If there is a pollution release, claimants can sue the guarantor directly in many cases. A guarantor’s total payout is limited to the money or policy limits it provided, but this does not limit other legal liabilities (for example, bad-faith claims) or reduce the polluter’s own legal liability.
