Title 42 › CHAPTER 105 — COMMUNITY SERVICES PROGRAMS › SUBCHAPTER I — COMMUNITY ECONOMIC DEVELOPMENT › Part C — Development Loans to Community Economic Development Programs › § 9812a
Loans made after September 30, 1986, or outstanding loans made after December 31, 1982 by the Secretary of Health and Human Services, that used money from the Rural Development Loan Fund or certain funds available before October 27, 1998 must have a fixed interest rate equal to the rate that applied to loans made with those funds in 1980. This only applies if the intermediary borrower’s weighted average interest rate for loans made after December 31, 1982 with those funds does not exceed that fixed rate plus 6 percent. A county government that got a loan between December 31, 1982 and September 30, 1986 using those same funds may transfer the loan contract to another eligible entity for the same purpose. The new entity becomes the party to the contract and must carry out the contract and its purpose.
