Title 43 › CHAPTER 32A — COLORADO RIVER BASIN SALINITY CONTROL › SUBCHAPTER I — PROGRAMS DOWNSTREAM FROM IMPERIAL DAM › § 1571
The Secretary of the Interior must carry out a program to improve and protect the Colorado River’s water for use in the United States and Mexico and to meet U.S. duties under the August 30, 1973 agreement made under the February 3, 1944 treaty. The Secretary can build, run, and keep up a desalting complex and related works. That includes a plant to treat about 129 million gallons per day, recover at least 70% as product water, and cut dissolved solids by at least 90%, plus intake and product lines, power facilities, operating buildings, a bypass drain into Mexico, a concrete siphon to replace a metal flume, land buying and irrigation improvements to lower return flows, storage lands at Painted Rock Reservoir, and other needed roads and lines. Power must not reduce supply to priority customers; excess Navajo Generating Station power may be used if revenues are protected and other supply options are studied first, and supplemental power may be bought starting October 1, 1979 if Congress provides money. Studies to find replacement water sources must finish by June 30, 1980 and are limited to the Colorado River basin states listed in the law. The Secretary may advance funds to the U.S. section of the International Boundary and Water Commission for the Mexican part of the bypass drain. Any extra desalted water can be sold and the money goes to the U.S. Treasury, and Yuma, Arizona, has first refusal. To cut return flows to 175,000 acre-feet a year or less, the Secretary can speed up irrigation efficiency work with the Wellton-Mohawk district (the district pays its share), buy or exchange land (initially about 10,000 acres), help farmers install better systems (with users repaying their share), and change the U.S.–district repayment contract so some costs are nonreimbursable or credited. The Secretary can get lands above Painted Rock Dam through the Corps of Engineers only after a court shows the Corps lacks authority to use them. Funds may be moved to the Department of Agriculture for on-farm help and research. All costs for the desalting complex are nonreimbursable except for the specific irrigation and farmer-assistance parts allowed by the law.
