Title 43 › Chapter 33— ALASKA NATIVE CLAIMS SETTLEMENT › § 1602
Gives the meanings of important words used in the chapter. Secretary means the Secretary of the Interior. Native means a U.S. citizen with one-fourth degree or more Alaska Indian (including Tsimshian Indians not enrolled in the Metlaktla Indian Community), Eskimo, or Aleut blood, or a mix of those; it also covers people with non‑Native adoptive parents and, if there is no proof of blood amount, a U.S. citizen who is accepted as an Alaska Native by the village or group they claim and whose mother or father was accepted as Native by a village or group. The Secretary’s decision about enrollment is final. Native village means a named tribe, band, clan, group, village, community, or association in Alaska listed in sections 1610 or 1615 or one that meets the chapter’s rules and that the Secretary finds had 25 or more Natives on the 1970 census date. Native group means a similar local Native unit with fewer than 25 Natives that makes up a majority of the locality. Public lands means federal lands in Alaska except the smallest tract needed for a federal installation and state land selections patented, tentatively approved, or identified for selection before January 17, 1969 (see section 6(g) of the Alaska Statehood Act). State means Alaska. Regional Corporation, Village Corporation, Group Corporation, Urban Corporation, and Native Corporation are the various Alaska Native corporations set up under state law to hold, manage, and distribute lands, money, and assets for their members. Person means individual or organization. Municipal Corporation means a local Alaska government. Fund means the Alaska Native Fund in the U.S. Treasury (section 1605). Planning Commission means the Joint Federal‑State Land Use Planning Commission (section 1616). Settlement Common Stock and Replacement Common Stock are types of Native Corporation stock defined in section 1606. Descendant of a Native means a lineal descendant of a Native or of someone who would have been a Native if alive on December 18, 1971, or an adoptee of a Native or descendant whose adoption happened before adulthood and is legally recognized. Alienability restrictions are limits on Settlement Common Stock in section 1606(h)(1)(B). Settlement Trust means a trust created and registered by a Native Corporation under state law by shareholder resolution to benefit shareholders, Natives, and descendants under section 1629e and state law.
