Title 43 › Chapter 12— RECLAMATION AND IRRIGATION OF LANDS BY FEDERAL GOVERNMENT › Subchapter V— ADMINISTRATION OF EXISTING PROJECTS › § 423
If land is found permanently unproductive under the survey in House Document 201 (69th Congress, 1st Session), as changed by General Recommendations 2 and 4 on page 60, it must be taken out of the project and will not get project water unless it is put back into the project. The United States will handle the old water right under the reclamation law, but current project water users have first claim. Any extra water that is temporarily available may be rented to excluded lands if the Secretary of the Interior approves the terms.
