§451c Cancellation of Charges or Liens; Credits

Summary

After approving an exchange application, the Secretary may cancel or remove, fully or partly, any charges or liens he controls on the person doing the exchange or on the farm they gave up. He must consider other existing charges and the rights of other lien holders and act in a fair way. An entryman who exchanges can get credit from the Secretary on land development charges for the new (lieu) farm for amounts already paid on the original farm. A resident owner—or, for a deceased owner, a widow, widower, heir, or devisee—their spouse or ancestor who paid the original purchase price can get credit toward the purchase price of the lieu farm; that credit can also be used for irrigation construction charges as allowed under section 451b.
