Title 43 › Chapter 22— RIGHTS-OF-WAY AND OTHER EASEMENTS IN PUBLIC LANDS › § 943
Lands in Minnesota that the President set aside because they might be flooded for dams, reservoirs, or other works to improve navigation on the Mississippi River and some tributaries are treated the same as regular public lands for railroad right-of-way laws. That applies to all times before February 27, 1901. If a railroad gets any of those lands, the United States still has the right to flood them when building or keeping dams or reservoirs for navigation. Railroads must file the maps the law required on February 27, 1901, and also file exact location maps showing the rail elevation with the Secretary of the Army. Railroad routes cannot use or block lands needed by the reservoir system as of February 27, 1901, or needed for building or extending dams, or raise the cost of that system. Plans for location and construction must be sent to and approved by the Secretary of the Army and the Chief of Engineers of the U.S. Army.
