The Director’s rules control how federal agencies manage information resources, unless this subchapter says otherwise. It does not change the powers of the Secretary of Commerce or the Director of the Office of Management and Budget under Reorganization Plan No. 1 of 1977 (as amended) and related executive orders about telecommunications, buying and managing telecom and information systems, spectrum use, and similar matters. The subchapter does not apply to collecting information during federal criminal investigations or prosecutions, certain civil suits or administrative actions against named people or firms, some antitrust compulsory processes (Antitrust Civil Process Act and section 13 of the Federal Trade Commission Improvements Act of 1980), or intelligence and cryptologic activities under Executive Order No. 12333, issued December 4, 1981. It does apply to broad, category-wide investigations (for example, an entire industry). It also does not change authorities given by sections 11331 and 11332 of title 40 or the President’s or OMB’s powers over agency programs, including enforcing civil rights laws.
