§7244 Federal Agency Responsibilities.

Summary

Agency heads must send the Director, between 30 and 60 days after a congressionally required report is sent to either House of Congress or a committee or subcommittee, the specific information listed in 44 U.S.C. 7243(b)(1)(A)–(D) about that report. Agencies still must post the full report on their own public portal and deliver it to Congress or committees as other laws require. The Director of the Office of Management and Budget must issue guidance on how to follow this subtitle and section 1125(b) of title 31 within 180 days after Dec. 23, 2024, and update it as needed. Agency heads must follow that guidance, name a point of contact for these reports, and the Director may only publish reports received from the agency head or someone the head has specifically authorized.

“(a)Not earlier than 30 days or later than 60 days after the date on which a congressionally mandated report is submitted to either House of Congress or to any committee of Congress or subcommittee thereof, the head of the Federal agency submitting the congressionally mandated report shall submit to the Director the information required under subparagraphs (A) through (D) of section 7243(b)(1) with respect to the congressionally mandated report. Notwithstanding section 7246, nothing in this subtitle shall relieve a Federal agency of any other requirement to publish the congressionally mandated report on the online portal of the Federal agency or otherwise submit the congressionally mandated report to Congress or specific committees of Congress, or subcommittees thereof.
“(b)Not later than 180 days after the date of the enactment of this subsection [Dec. 23, 2024] and periodically thereafter as appropriate, the Director of the Office of Management and Budget, in consultation with the Director, shall issue guidance to agencies on the implementation of this subtitle as well as the requirements of section 1125(b) of title 31, United States Code.
“(c)The head of each Federal agency shall ensure that each congressionally mandated report submitted to the Director complies with the guidance on the implementation of this subtitle issued by the Director of the Office of Management and Budget under subsection (b).
“(d)The head of each Federal agency shall designate a point of contact for congressionally mandated reports.
“(e)The Director shall not publish any report through the reports online portal that is received from anyone other than the head of the applicable Federal agency, or an officer or employee of the Federal agency specifically designated by the head of the Federal agency.
