Title 45 › Chapter 21— ALASKA RAILROAD TRANSFER › § 1208
After January 14, 1983, a State or a State-owned railroad can ask the Secretary of the Interior or the Secretary of Agriculture to quickly approve a right-of-way so the Alaska Railroad or the State railroad can cross Federal land for transportation. The State can also apply for leases, permits, or transfers for nearby terminal, station, and material sites. Before approval, the Interior or Agriculture Secretary must consult with the Secretary and follow applicable law. Rights-of-way and sites should, when possible, meet the standards in the Act of March 12, 1914 (43 U.S.C. 975 et seq.) and section 1202(6), and that requirement remains despite repeal under section 615.
