Creates the National Railroad Adjustment Board to hear and decide labor disputes between rail carriers and railroad employees. The Board has 34 members: 17 chosen by carriers and 17 by national labor organizations. Carriers and labor groups set their own rules to pick members, and no carrier or labor group can have more than one voting representative on a division. If selections are not made on time, the Mediation Board will appoint the missing members (original picks were due within 30 days after June 21, 1934; back-ups must be made by the Mediation Board if picks are not made within 60 days after June 21, 1934 for first appointments, or within 30 days after a vacancy). The Board meets in Chicago and has four independent divisions with set jobs and sizes: First (train and yard service) has 8 members (4 carrier, 4 labor); Second (shop and trades) has 10 (5 and 5); Third (station, clerical, maintenance, etc.) has 10 (5 and 5); Fourth (water transportation and other employees) has 6 (3 and 3). Employees must try the usual grievance steps up to the carrier’s chief operating officer first; if not settled, either side can petition the proper division with facts and evidence. Hearings may be in person or by representatives. A majority of eligible division members must agree to make an award. If the division deadlocks, it must pick a neutral referee to join and decide; if it cannot pick one in 10 days, the Mediation Board will appoint the referee. Awards are written, final, and binding. If a carrier fails to follow an award, the winning party can sue in federal district court to enforce it; court review is limited and may only overturn awards for specific legal reasons (for example, lack of jurisdiction or fraud). Lawsuits based on an award must start within two years of when the claim arises. The Board may create regional or special boards by agreement; those boards work the same way and their awards are enforceable the same way.
