Title 45 › Chapter 18— MILWAUKEE RAILROAD RESTRUCTURING › § 915
Bankruptcy courts handling railroad cases that were still pending on November 4, 1979, can allow railroads to abandon tracks or to sell or transfer lines so service can stop or continue. For abandonments, a court may let service end even while an appeal is pending, and that order cannot be put on hold. The court must require arrangements that protect employees at least as much as the federal railroad rules require. A sale or transfer that will keep trains running must also be reviewed by the federal rail agency (the Commission). If the buyer applies to the Commission on or after November 1, 1979, the Commission must act (with or without a hearing) within the time the court sets, which cannot be more than 180 days. If someone offered to buy lines with no service and the trustee rejected them, that person can apply to the Commission. The Commission has 15 days to check they are financially responsible and made a real offer. The parties get 30 days to agree. If they cannot, either side can ask the Commission to set terms; the Commission must do so within 60 days and the buyer can withdraw within 10 days. The Commission then sends the terms to the court within 15 days, and the court must approve those terms within 60 days if the money meets the constitutional minimum. The Commission must try to have the buyer use current or former employees as much as possible. A buyer may not transfer or stop service for 4 years after buying. The court may allow temporary operation while the Commission reviews an application. Orders the Commission made before November 1, 1979, can only be reviewed under specified judicial standards and cannot be stayed by the Commission. The Milwaukee Railroad follows different rules under another part of the law. Nothing here changes the order or timing of employee protection payments.
