A judge must pick three experienced marine surveyors to inspect a ship when the crew files a complaint. The surveyors can collect evidence and, if the issue is food or water, should include a Public Health Service medical officer if one is available. At least two surveyors must sign a written report saying if the ship is fit to sail and naming needed repairs, supplies, or extra crew. The judge then writes a decision the captain and crew must follow. The captain pays the survey costs. If the complaint was clearly groundless or a food/water claim had no reasonable basis, the captain or owner may take the costs and fair detention damages from the complainants’ wages. A captain who refuses to pay costs and wages owes the United States a $100 civil penalty and must pay anyone harmed by the refusal.
