Owners may ask the Secretary to leave certain spaces out when measuring a vessel’s gross tonnage under section 14512. The Secretary must approve the request and the excluded spaces must be like those that could have been excluded under section 2 of the Act of September 29, 1965 (Public Law 89–219, 79 Stat. 891) as that section stood before this rule. The Secretary must set the design, place, and size of the tonnage mark put on the vessel. If a vessel has two sets of gross and net tonnages, each certificate must show the tonnages for when the tonnage mark is submerged and for when it is not. Otherwise, a certificate may show only one set of tonnages.
