The Secretary can order a person to pay a civil penalty after giving notice and a chance for a hearing if the person broke rules under this subtitle or subtitle VII. The Secretary must send the amount in writing and must look at the violation’s nature, seriousness, scope, the person’s blame, past offenses, ability to pay, and other fairness factors when setting the amount. The Secretary may reduce, change, or cancel a penalty until the amount is sent to the Attorney General. If a final penalty is not paid, the Secretary can ask the Attorney General to collect it in federal court.
