Title 46 › Subtitle Subtitle III— Maritime Liability › Chapter 301— GENERAL LIABILITY PROVISIONS › § 30101
Federal maritime courts can hear cases when a vessel on navigable water causes injury or property damage even if the harm is completed on land. You may sue the vessel itself or the people responsible, and the case follows the same rules as if the injury had happened on the water. If the defendant is the United States, your only legal route is under chapter 309 or 311 of Title 46. You must wait 6 months after you present a written claim to the agency that owns or operates the vessel before you can file that lawsuit.
