Subject to section 42306, if the Federal Maritime Commission finds the conditions in section 42302(a) and asks for action, the Secretary of Homeland Security must refuse the clearance under section 60105 for any foreign carrier vessel the Commission names. The Secretary who runs the Coast Guard must then either deny that vessel entry for ocean trade into U.S. ports or waters or detain it at the U.S. port it is about to leave.
