Create a “Tanker Security Fleet” made up of privately owned U.S. product tank ships that have operating agreements under this law. The Secretary of Transportation, working with the Secretary of Defense, must set up and run the fleet so the United States has the ships it needs for defense and security and keeps a presence in international shipping. A ship can join the Fleet only if it meets one of four ownership/operation options in subsection (c) and also: will carry goods in U.S. foreign commerce, is self-propelled, is no older than 10 years when first added, is found by the Secretary of Defense to be useful for defense in war or emergency, and is judged commercially viable by the Secretary of Transportation. The ship must be a U.S. vessel or the owner must intend to document it under chapter 121 and be eligible to do so when an operating agreement is made. If needed, the Secretary of Defense will ask the Secretary of Homeland Security for any waiver under section 501. A ship that met the criteria but was not documented under chapter 121 when this law passed can get a Coast Guard certificate of inspection if it is classed by the American Bureau of Shipping (or an accepted society), follows the international rules as determined by its former documenting country, and that country is not flagged by the Commandant of the Coast Guard for poor enforcement. The Commandant may accept classification society certificates, but a foreign society is accepted only if its government gives reciprocal access to the American Bureau of Shipping and the society has U.S. offices and records. When required certifications are made, the Secretaries of Transportation and Defense must tell the relevant Senate and House committees that they agree and see no legal, operational, or other barriers.
