Foreign vessels cannot unload fish or fish products taken on the high seas in U.S. ports, unless this law or an international treaty says they can. That ban covers fish caught on the ship or taken from another fishing vessel. The Secretary of Commerce can make rules to gather information about U.S. vessels that carry fish products for foreign processors to places in the United States. The rule banning unloading does not apply to the Northern Mariana Islands. A foreign vessel 50 feet long or less may unload fresh fish in the Virgin Islands only for immediate local use. "Fresh" means not frozen or further processed. If fish are kept, sold, or moved there other than for immediate use, they can be seized and become U.S. property, and the person involved can be fined up to $1,000 for each violation. Fines or forfeitures can be changed under section 2107(b).
