Defines three key words used in the chapter. Marine highway transportation means moving cargo on a documented ship when the cargo is loaded in certain ways (for example, in intermodal containers lifted by crane; loaded by wheeled methods like roll‑on/roll‑off; shipped as individual packages or palletized units; carried as bulk, liquid, or loose cargo in tanks, holds, hoppers, or on deck; or as freight vehicles on commuter ferries) and the trip is between a U.S. port and another U.S. port or a port in Canada or Mexico, in either direction. Tribal government means the officially recognized governing body of any Indian or Alaska Native tribe or related entity listed in the most recent federally recognized tribes list published under section 104 of the Federally Recognized Indian Tribe List Act of 1994 (25 U.S.C. 5131), as of the date of enactment of the James M. Inhofe National Defense Authorization Act for Fiscal Year 2023. Alaska Native Corporation means the same thing as “Native Corporation” in section 3 of the Alaska Native Claims Settlement Act (43 U.S.C. 1602).
