Vessels and the people on them who fail to follow or who block rules under this part can lose the vessel and its gear, and the person can be jailed for up to ten years and may be fined up to $10,000. Any other person who knowingly disobeys or blocks the rules faces the same jail time and possible $10,000 fine. A civil penalty of up to $25,000 can be charged for each violation, and each day the violation continues counts as a separate violation. A vessel used in breaking these rules can be held responsible and sued in federal court where it is found. The Secretary in charge of the Coast Guard may refuse or cancel the vessel’s clearance under section 60105 and can require a bond before allowing clearance.
