Title 46 › Subtitle II — Vessels and Seamen › Part F — Manning of Vessels › CHAPTER 81 — GENERAL › § 8106
Owners and managers of U.S. freight ships on SOLAS voyages must control and document any temporary workers who ride the ship ("riding gang members"). They must make sure each rider is either a U.S. citizen, a lawful permanent resident, or has the required U.S. nonimmigrant visa and other travel papers. All paperwork must be kept on board and each rider put on the crew list. Owners must check backgrounds, sign a certificate saying no credible security risks were found, keep that certificate on board, and share background information with the Secretary if asked. Riders must follow the same random drug and alcohol testing as crew and get Coast Guard‑approved basic safety training. Owners must stop anyone convicted of certain maritime crimes, anyone whose mariner papers are suspended or revoked, or anyone who is otherwise a safety threat from boarding or make them leave at the next port. The total number of riders plus any other extra people allowed by law may not exceed 12. Riders must be supervised by a licensed officer and work only with credentialed crew. Riders must be employed under international labor standards. Non‑citizen, non‑permanent resident riders may only do limited work: prepare a ship before entering an overseas shipyard, finish repairs after leaving an overseas shipyard, or do technical in‑voyage repairs beyond the crew’s abilities to keep the ship going. An owner may use such riders no more than 60 workdays in a year; if a rider reaches 60 days while at sea, they must be taken off at the next port. Warranty work by manufacturer reps is exempt from these limits in certain cases. Owners must log required information in the ship’s official log. If U.S. citizens or lawful permanent residents who are qualified and available were not used, the owner can face a civil penalty of up to $10,000 per day, up to $100,000 total, with possible reductions by the Secretary.
