Title 47 › CHAPTER 12 — BROADBAND › § 1305
The Assistant Secretary of Commerce, working with the FCC, must set up a national program called the Broadband Technology Opportunities Program to expand and improve broadband across the country without conflicting with other federal efforts. The program must reach areas without service and improve service in underserved places. It must help schools, libraries, health care providers, colleges, community groups, low-income and vulnerable people, and job-creating facilities use broadband. It must also help public safety agencies and encourage more broadband use, economic growth, and jobs. Eligible applicants include states, local governments, tribes, nonprofits, and other organizations (including providers) the Assistant Secretary allows. Grants will be competitive, can pay for equipment, networks, and infrastructure, support community anchor institutions, help vulnerable populations, improve public safety communications, and other projects that match the program goals. Federal funding normally cannot cover more than 80% of a project unless a waiver shows need. The Assistant Secretary must run the grant program quickly, make all awards before the end of fiscal year 2010, seek assurances that projects finish within 2 years of an award, and report to Congress every 90 days. Grantees must report quarterly, the public must be able to search a database of applications and reports, and the agency can take back funds for poor performance. The FCC must deliver a national broadband plan within 1 year after February 17, 2009, and the Assistant Secretary must publish an interactive nationwide broadband map within 2 years after February 17, 2009. The Assistant Secretary can make rules needed to run the program.
