Title 47 › CHAPTER 15 — SECURE AND TRUSTED COMMUNICATIONS NETWORKS › § 1603
The Commission must run a program called the Secure and Trusted Communications Networks Reimbursement Program. It pays eligible advanced communications providers (those with 10,000,000 or fewer customers who make required certifications) to permanently remove certain covered communications equipment or services, replace them with non-covered equipment or services, and dispose of the old gear as the rules require. Reimbursement money can only be used for those three things. Funds cannot be used to remove or buy covered equipment obtained on or after the Report and Order’s publication or, for equipment that became covered under the Designation Orders, on or after June 30, 2020. Providers must give a cost estimate when they apply and may have to update it. The Commission must decide on applications within 90 days (it can add 45 days if overwhelmed) and give applicants 15 days to fix major deficiencies. The Commission will make a technology-neutral list of suggested replacements. After December 27, 2020, funds go first to approved providers with 2,000,000 or fewer customers, then to accredited non‑commercial educational institutions that run their own broadband, then to other approved applicants. If $1,000,000,000 won’t cover approved requests, the Commission must notify Congress. Total spending may not exceed $4,980,000,000. Recipients must finish removal, replacement, and disposal within 1 year after getting funds. The Commission can grant a 6‑month general extension if replacement supply is short, and may grant up to two 6‑month individual extensions for no‑fault delays. Recipients must give status updates at least every 90 days (the Commission will post updates publicly not sooner than 30 days after receipt) and the Commission must report to Congress every 180 days. The Commission will require regular spending reports, run audits and field checks, and require final certifications that work and timelines were completed. If an item is later removed from the covered list, a recipient may return the related funds to be released from the obligation or keep the funds and still complete the work. The Commission must start rulemaking within 90 days after March 12, 2020 and finish it within one year, and it must help educate providers about the program. The program is separate from federal universal service programs.
