Title 47 › CHAPTER 16 — BROADBAND ACCESS › SUBCHAPTER I — BROADBAND GRANTS FOR STATES, DISTRICT OF COLUMBIA, PUERTO RICO, AND TERRITORIES › § 1702
Creates a grant program called the Broadband Equity, Access, and Deployment Program that must be set up by the Assistant Secretary within 180 days after November 15, 2021. It provides $42,450,000,000 to States to bring reliable internet to places that lack it. Each State gets at least $100,000,000, and $100,000,000 is split equally among the U.S. Virgin Islands, Guam, American Samoa, and the Northern Mariana Islands. Ten percent of the money is set aside for higher-cost unserved areas. States must send letters of intent, then an initial proposal, and then a final proposal to get the money. States can use up to 5% of their initial allocation for planning and up to 2% for administration. The Assistant Secretary can use up to 2% of the total for administration. Funds can pay for building networks to unserved or underserved areas, connecting schools and clinics, mapping and planning, wiring multi-family housing, programs that help people get online, and other needed uses. Projects must meet quality and cybersecurity rules, generally provide service at no less than 100/20 Mbps with low latency, limit outages to an average of 48 hours per year, offer at least one low-cost plan, and normally begin serving customers within 4 years. A 25% non-Federal match is required unless waived or in high-cost areas. The Assistant Secretary must keep a public, searchable database of grants, require regular reports, allow local challenges to service-area decisions, reallocate unused funds, and has exempted these actions from some federal paperwork and rulemaking laws. Key words: Unserved location = no service or below 25/3 Mbps; Unserved/underserved service project = at least 80% of served locations meet those tests; Underserved location = below 100/20 Mbps; Eligible community anchor institution = places like schools or libraries that lack gigabit service; Eligible entity = a State; Assistant Secretary = Assistant Secretary of Commerce for Communications and Information; Broadband DATA maps = the maps made under section 802(c)(1) of the Communications Act; Commission = the Federal Communications Commission.
