Lets satellite TV companies carry TV stations from outside a viewer’s local area if the Federal Communications Commission (FCC) has found that people in that community watch that station enough to call it "significantly viewed." Signals already so found before December 8, 2004, may be carried unless blocked by existing exclusivity rules. Signals found by the FCC after December 8, 2004, may be carried if they meet the same viewing-share and survey tests used for cable systems. The rule applies only to satellite customers who already get local TV under existing satellite rules. A station may be carried in high definition only if the carrier also carries the local affiliate in high definition when that format is available, except where no local affiliate for that network exists or the local affiliate gives a written waiver. The FCC had to publish a list of eligible stations and communities within 60 days after December 8, 2004, start a rulemaking then, and adopt rules within 1 year after that date. The FCC must keep an online list and update it within 10 business days after any change. Complaints can lead the FCC to order a stop. If a carrier violated the rule in bad faith, the FCC may award damages up to $50 per subscriber, per station, per day; if a complaint is frivolous, the carrier may get up to $50 per subscriber, per station, per day. The FCC must decide complaints within 180 days.
