Lets people affected by a Commission decision ask the same authority to look at it again. The request must go to whoever made the decision and must be filed within 30 days after the Commission gives public notice. The authority can decide to grant a reconsideration if there is a good reason. Filing the request does not stop people from having to follow the order unless the Commission orders a delay. You do not always have to ask for reconsideration before going to court. The exception is if you were not part of the original case or you raise facts or legal questions the Commission never had a chance to consider. The Commission must issue a short written decision that grants or denies the request and can order more proceedings. If the request is about an authorization given without a hearing, the Commission must act within 90 days. Only newly discovered evidence, evidence that became available after the first proceeding, or evidence the Commission thinks should have been taken then may be offered on reconsideration. When the request follows a hearing or an investigation, the Commission must decide within 90 days, and that decision is final and can be appealed.
