A local franchising authority may give one or more cable TV franchises inside its area. It cannot give an exclusive franchise. It also cannot unreasonably refuse to let a second company compete. If someone is finally denied a second franchise, they can appeal under section 555. A franchise lets a cable company build its system in public rights-of-way and in easements meant for similar uses. While doing that, the cable company must not harm safety, use, or appearance of the property. The company or its subscribers must pay installation and removal costs, and the company must fairly pay owners for any damage. The franchising authority must not refuse service to a neighborhood because residents are low income. It must give the company a reasonable time to reach all homes. The authority may require proof the company will provide public, educational, and government access channels or money for them. It may also require proof of the company’s finances, technical ability, or legal standing. A cable operator needs a franchise to provide cable service, except if it was lawfully providing service on July 1, 1984 and the authority does not require a franchise. If a cable company or its affiliate offers telecommunications services, those services do not need a franchise and are not covered by this subchapter. States or the FCC may require informational tariffs for non‑cable communications services a cable system offers that would otherwise be regulated. States keep their power to regulate non‑cable communications and to license systems serving only residents of a single multiunit building that do not use public rights‑of‑way. A local government that also acts as the franchising authority may run a multichannel video service and does not have to get a franchise to do so.
