Title 47 › CHAPTER 5 — WIRE OR RADIO COMMUNICATION › SUBCHAPTER V–A — CABLE COMMUNICATIONS › Part III — Franchising and Regulation › § 546
A local government that issues cable TV franchises may start a renewal review during the 6-month window that begins 36 months before the franchise ends. That review is to find out future community needs for cable and to check how the cable company has performed. If the cable company gives a written renewal notice during that 6-month window, the local government must start the review within 6 months after getting the notice. The cable company can only use the formal renewal steps if it asked for the review on time or if the local government started the review on its own. After the review, the cable company can send a renewal proposal with the information the local government asks for, including any system upgrade plans. When a proposal is filed, the local government must give public notice and, within a 4-month period from the filing date, either renew the franchise or say it likely will not renew and, if needed, hold an administrative hearing. The hearing looks at four things: compliance with the franchise and law, service quality, the company’s ability to provide the services, and whether the proposal reasonably meets future community needs given the costs. The company and the local government can present evidence, question witnesses, and get a transcript. The local government must issue a written decision with reasons. Denials must be based on the four listed factors and follow rules about notice and chances to fix problems. The company may appeal under section 555 of this title. A decision is not final until state administrative review is finished or the time to seek it has passed. “Franchise expiration” means the franchise end date as it was on October 30, 1984. A company may also submit a renewal proposal at any time under alternate rules, and a lawful revocation for cause is not stopped by later renewal actions.
