The Governor must appoint the heads of executive agencies and instrumentalities with the legislature’s approval, unless another rule in this chapter or Guam law says otherwise. The legislature must create a merit system, and hiring and promotions should follow it when possible. Guam may set up a Civil Service Commission to run the merit system, and members of that commission can be removed under Guam law. Officers get the powers given by law or by the Governor’s executive rules if those rules don’t conflict with law. The Governor must review and reorganize the executive branch as needed for good management and to carry out this chapter and Guam law. People holding office on August 1, 1950 may stay in their jobs until their successors are appointed and qualified, unless another rule applies.
