Title 48 › Chapter 3— HAWAII › § 644a
The U.S. District Court for Hawaii has authority over civil and criminal cases that happen on or near several Pacific islands: Midway, Wake, Johnston, Sand, Kingman Reef, Palmyra, Baker, Howland, Jarvis, Canton, and Enderbury. Applying this to Canton and Enderbury does not harm the United Kingdom’s claims under the April 6, 1939 agreement. Acts, deeds, and crimes on those islands or in nearby waters are treated as if they occurred on the high seas aboard a U.S. merchant or other U.S. ship. Those matters are decided under U.S. laws for shipboard cases, and U.S. jury rules apply.
