Rail carriers must not unfairly treat a person, place, port, or kind of traffic. Unfair means charging or getting different pay for the same service and the same kind of traffic when the situation is basically the same. The rule does not apply to certain contracts (see section 10709), to different routes, or to treating another carrier’s traffic differently. Rate differences are allowed when carriers provide different services.
