Rail carriers must keep a cost accounting system that follows the Board’s rules under section 11161. A carrier can change its system after telling the Board. The Board then has 60 days from that notice to object if the change does not follow those rules. The Board may examine and copy any carrier documents about following the rules. Those records and copies are not subject to mandatory public disclosure under section 552 of title 5.
