Anyone hurt by motor vehicle transportation or service that clearly breaks sections 13901–13904 or 13906 may sue to enforce those rules. The trial must be held in the judicial district where the person who broke the rule operates. A copy of the complaint must be served on the Secretary, and the complaint filed in court must include a certificate showing service. The Secretary may join the case or tell the court it will review the matter; if the Secretary notifies the court, the court must pause the lawsuit until the Secretary finishes. The court may award the winning party a reasonable attorney’s fee, plus costs allowed under the Federal Rules of Civil Procedure.
