If a pipeline carrier breaks Board orders (except an order that only tells it to pay money), a person hurt by that can sue in court to make the carrier follow the order. A carrier that charges more than the correct rate or that causes harm by breaking the rules must pay the extra charges or damages. A person can complain to the Board or sue in court to get these payments. When the Board orders money, it will set the date to pay; if the carrier does not pay, the person can sue to enforce the order. A court complaint must include the Board’s order. Either a U.S. district court or a state trial court with proper authority can enforce the order. The Board’s findings count as evidence. If a court awards damages, it must also add a reasonable lawyer’s fee and collect it as part of the costs. The plaintiff only pays costs that result from an appeal the plaintiff starts.
