A pipeline carrier must start a lawsuit to collect charges within 3 years after the claim starts. A person must sue to recover overcharges under section 15904(b)(1) within 3 years, or file a complaint with the Board under 15904(c)(1) within 3 years if they choose that route. To get damages under 15904(b)(2), a person must file a Board complaint within 2 years. If a written claim is filed and the carrier sends a written notice denying part of it, the 3-year limits in (b) are extended by 6 months from that notice. The time limits in (b) and the 2-year limit in (c) are also extended by 90 days if the carrier sues under (a) or collects the charge within the proper period. To enforce a Board money order, start a lawsuit within 1 year after the payment date in the order. For U.S. Government shipments, the time limits are extended 3 years from the date of payment, a later refund, or a deduction under section 3726 of title 31. A claim about a shipment starts when the carrier delivers or offers to deliver the property.
