Title 49 › SUBTITLE I — DEPARTMENT OF TRANSPORTATION › CHAPTER 3 — GENERAL DUTIES AND POWERS › SUBCHAPTER I — DUTIES OF THE SECRETARY OF TRANSPORTATION › § 303
The federal government requires special efforts to protect the natural beauty of the countryside, public parks and recreation lands, wildlife and waterfowl refuges, and historic sites. The Secretary of Transportation must work with the Secretaries of the Interior, Housing and Urban Development, Agriculture, and with state officials to plan transportation so those places are kept or improved. A transportation program or project that would use publicly owned park, refuge, or historic land can only be approved if there is no practical alternative and the project includes all possible planning to reduce harm. This rule does not apply to certain park roads or parkways covered by another law. Small impacts may be handled faster. For historic sites, a project can be treated as having only a very small impact if there is a finding, after the required historic consultations, that there is no adverse effect or no historic properties, and the State or tribal preservation officer and the Advisory Council agree in writing. For parks and refuges, the Secretary can find a very small impact only after public notice, review, and agreement by the officials in charge. The Secretary must align these steps with National Environmental Policy Act procedures, coordinate with Interior and the Advisory Council (within 90 days), and post certain notices online within 3 days. Some common post‑1945 concrete or steel bridges or culverts already exempt from historic review are also exempt here. Work on rail lines in use or historically used for transport is generally not treated as using a historic site, but that rule does not apply to stations or to bridges and tunnels on abandoned or out‑of‑use lines, with certain clarifications.
