Foreign air carriers must send a written plan to the Secretary of Transportation and the Chairman of the National Transportation Safety Board about how they will help families when a crash they control causes any loss of life. Definitions: Aircraft accident — any aviation disaster that happens in the United States, no matter the cause. Passenger — the meaning given in section 1136. To the extent allowed by foreign law in effect when this requirement was made, the plan must include things like a reliable toll-free phone number and staff for family calls; a way to tell families in person, when possible, before names are released publicly; quick family notice once a passenger’s identity is verified; providing and updating passenger name lists to designated family support officials; consulting families about remains, personal items, and any U.S. memorials; returning a passenger’s possessions on request unless needed for an investigation; keeping unclaimed items for not less than 18 months; giving the same treatment to nonrevenue passengers and ground victims; working with and paying any designated family-support organization; helping families travel to and stay near the accident site; training staff and committing resources; consulting the NTSB and the State Department if the carrier helps U.S. citizens in the U.S. after a fatal crash abroad; promptly giving written notice to private owners of damaged property with advice to contact their insurer, not rely on unofficial promises of compensation, and collect evidence quickly; and making any NTSB public hearing more than 80 miles from the crash site available electronically in the flight’s U.S. origin and destination cities. An applicant for a permit must include such a plan before approval. A carrier is not liable in court for preparing or giving a passenger list under the plan unless its conduct was grossly negligent or intentional misconduct.
