Title 49 › SUBTITLE VII — AVIATION PROGRAMS › PART A — AIR COMMERCE AND SAFETY › subpart iii — safety › CHAPTER 441 — REGISTRATION AND RECORDATION OF AIRCRAFT › § 44108
A conveyance, lease, or security instrument is only legally effective before it is filed for recording against the person who made it, that person’s heirs, and anyone who actually knew about it. Once the document is filed under section 44107, it takes effect from the filing date against everyone without any other filing. But if it is filed under the parts that name a specific engine or propeller, it applies to that named engine or propeller even if other filings exist. If it is filed under the parts that rely on a location, it only covers items at the place the document names. Whether the document is valid follows the laws of the state, District of Columbia, or territory where the document was delivered. If the document says where it was delivered, that place is presumed correct. These rules do not override the Convention on the International Recognition of Rights in Aircraft (4 U.S.T. 1830) or the Cape Town Treaty. The rules do not apply to conveyances made before August 22, 1938, or to leases or instruments made before June 20, 1948.
