Flight instructors, pilot schools, and aviation training centers must tell the Secretary of Homeland Security before giving instruction in planes that have a maximum certified takeoff weight over 12,500 pounds to an alien or any person the Secretary names. They must send the person’s full name (and any other names), passport and visa details, country of citizenship, birth date, training dates, and fingerprints taken by or under the supervision of a law enforcement agency or another approved entity (including U.S. personnel at embassies). If the Secretary does not order a stop within 30 days after that notice, the training may start. If the Secretary finds a safety or security risk later, the school must stop training immediately after being told. For aircraft 12,500 pounds or less, the school must just notify the Secretary and give the person’s ID in the form the Secretary requires. The Secretary must set up a faster process so the 30-day wait is no more than 5 days for certain low-risk people (for example, foreign pilots with a recognized airman certificate, employees of certified foreign airlines with approved security, people with unescorted access to secured airport areas, or other classes the Secretary finds low risk). “Training” here means instruction in an aircraft or simulator and does not include recurrent training, ground classes, or demonstration flights for marketing. Foreign military pilots endorsed by the Department of Defense are exempt. The Secretary may charge a fee for the review—up to $100 per person in fiscal years 2003 and 2004 and adjustable after that to cover costs—with the fees credited to and available from the Treasury account that paid the expenses. The Attorney General, the Director of Central Intelligence, and the FAA must help the Secretary. Flight schools must run a security awareness program for their employees.
