Title 49 › SUBTITLE VII — AVIATION PROGRAMS › PART B — AIRPORT DEVELOPMENT AND NOISE › CHAPTER 471 — AIRPORT DEVELOPMENT › SUBCHAPTER I — AIRPORT IMPROVEMENT › § 47105
A sponsor can apply for a project grant to the Secretary of Transportation. A State can apply as the only sponsor for projects or planning that help one or more airports in the State, but only if each airport’s sponsor gives written consent, the Secretary finds administrative and aeronautical benefit, and there is an agreement that the State will follow required grant conditions. Before starting an airport development project, the sponsor must talk with airport users who will be affected. A public agency cannot apply if doing so would break state law. Applications must describe the project, be for a public-use airport on the current national plan, meet the Secretary’s approved standards for things like site, layout, paving, lighting, and approach safety, and use the form and information the Secretary requires. The Secretary can approve a State’s standards for nonprimary public-use airports (except approach safety); approved State standards replace the comparable federal ones and can be changed with the Secretary’s okay. If a State asks, the Secretary must give technical help on pavement standards within 30 days and keep helping until those standards are approved. The Secretary can require a sponsor to certify compliance and can withdraw that acceptance. After January 1, 1995, pavement replacement or reconstruction can be approved only if the sponsor shows the airport has an effective pavement maintenance-management program. If money is apportioned under section 47114(c), the sponsor must tell the Secretary which fiscal year it plans to apply for that amount, using the timing and details the Secretary sets.
