States must not give or renew a driver's license endorsement to transport hazardous materials unless the Department of Homeland Security first finds the person is not a security risk after a background check, or the person already has a valid transportation security card under 46 U.S.C. 70105. When a State asks for that check, the Attorney General must run it and tell Homeland Security the results. The check includes criminal records, immigration status for noncitizens, and international checks (like through INTERPOL) when needed. States must send Homeland Security the names and other details the Department needs about people they license to haul hazardous materials. The Department of Health and Human Services must tell the Department of Transportation when a chemical or biological agent is a serious health risk and should be treated as hazardous. The Transportation Security Administration must set up a process within 90 days to notify an employer about a denied applicant’s threat assessment when appropriate, start rulemaking within the time limits (60 days after a report but no later than 120 days after enactment) to compare other required checks to this one, and change the definition of “transportation security incident” to exclude nonviolent work stoppages within 30 days. The TSA must also send reports to Congress on fingerprinting and plans to reduce duplicate checks. Six months after enactment, drivers registered in Mexico or Canada must pass similar background checks before carrying hazardous materials in the U.S.; the TSA head may extend that deadline by up to 6 months. Defined terms: “issue” — includes renewing a license. “Alien” — meaning in section 101(a)(3) of the Immigration and Nationality Act. “Commercial motor vehicle” — meaning in section 31101.
